HEALTH GUARANTEE
At Purchase: Tangle Ridges guarantees the Puppy to be healthy at the time of sale. All puppies have been vet checked healthy when they leave Tangle Ridges. Within three (3) business days after purchase, Buyer will have the Puppy examined by a licensed veterinarian at the Buyer's expense. If the Puppy is found to have an untreatable disease at that examination, Buyer may return the Puppy to Tangle Ridges within seven (7) days of the purchase for a replacement puppy of equal or lesser value, or pay the difference if greater value, provided:
a) The Puppy is returned in the same state of health in which it was sold; and
b) The Puppy has not suffered any intervening injury, illness or neglect.
Up to 26 Months from Date of Birth: Tangle Ridges guarantees the Puppy to be free from the genetic defects of: Dermoid Sinus and Hip Dysplasia. If, up to 26 months from the Date of Birth of the Puppy, the Puppy is positively diagnosed by a licensed veterinarian at the Buyer's expense as having the genetic defects of Dermoid Sinus or Hip Dysplasia, Buyer has the option of returning the Puppy to Tangle Ridges, at Buyer's expense, and selecting a replacement puppy of equal or lesser value, or pay the difference if greater value, provided:
a) Buyer provides Tangle Ridges with the veterinarian's written report indicating the diagnosis of Dermoid Sinus or Hip Dysplasia;
b) Buyer returns the Puppy to Tangle Ridges within fourteen (14) days of the veterinarian's diagnosis;
c) Tangle Ridges' licensed veterinarian has confirmed the Buyer's veterinarian's diagnosis (in the case of a contradictory result, Tangle Ridges' veterinarian's diagnosis will prevail);
d) The Puppy is returned to Tangle Ridges in good health; and
e) The Puppy has not suffered any intervening injury, illness or neglect.
This guarantee is ONLY for the genetic defects of Dermoid Sinus and Hip Dysplasia.
If Buyer does not find a suitable replacement puppy from the same litter or no puppies are available at that time, the Buyer Reservation Fee and Purchase Price may be applied to the purchase of another puppy from Tangle Ridges from a future litter. NO REFUNDS FOR ANY REASON.
This Agreement contains the entire agreement between the parties and no statement or verbal agreements made by either party that are not contained in this written Agreement shall be valid or binding. This Agreement may not be modified or altered except in writing signed by both parties. Violations of this Agreement will constitute a Breach of Contract, prosecutable by law, and may result in mandatory confiscation and return of the Puppy to Tangle Ridges.
The Buyer agrees that Tangle Ridges is in no way liable or responsible for any behavioral problems associated with, or damage, accident, or injury resulting from the Puppy.
The Buyer agrees to pay Tangle Ridges any and all expenses, including court costs and reasonable attorney fees, in enforcing the terms and provisions of this Agreement.
The parties agree this Agreement is made pursuant to the applicable laws of the State of Arizona and jurisdiction shall be held solely by a court of competent jurisdiction located in Maricopa County, Arizona.
